Terms and conditions
1. DEFINITION AND OBJECT OF THE CONTRACT
This contract ("Contract") is a distance contract pursuant to art. 50 and ss. Of Legislative Decree 6 September 2005, n. 206 ("Consumer Code"). The Contract concerns the sale of movable property between Pharbes of Dr. Bellomo Domenico of Dr. Domenico Bellomo, with registered office in Agrigento, Via P. Mattarella, 6 - VAT number 01969180841 and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by Pharbes of Dr. Bellomo Domenico of a purchase proposal issued by the Customer by telephone or via the Internet, following the invitation to offer content in the teleshopping broadcasts, on the site web www.elailab.com (the "Site") and / or through other Pharbes distance selling systems, based on the methods described on the Site and in this Agreement.
2. PRICES
The sales prices of the products illustrated on the Pharbes website of Dr. Bellomo Domenicos include VAT. and all other taxes. Delivery costs are shown on the Site.
3. METHOD OF PURCHASE AND PAYMENT
3.1 Methods
The Customer will be allowed to choose one of the following payment methods: (a) Bank Transfer; (b) Pay Pal or (c) by any other means of payment from time to time indicated as valid by Pharbes of Dr. Bellomo Domenico through the Site.
3.2 Invoicing
For every order placed on the site, Pharbes del Dott. Bellomo Domenico will issue a receipt sent. Any billing request must be requested by email to info@elailab.com before entrusting the goods to the courier. For the issuance of the invoice, the information provided by the Customer during the purchase procedure is valid. After the invoice has been issued, it will not be possible to make any changes to the data indicated therein. The amounts will be shown on the invoice exclusively in Euros.
4. DELIVERY OF PRODUCTS - COMPLAINTS
4.1 Delivery
Pharbes of Dr. Domenico Bellomo delivers the products to the address indicated by the Customer.

5. AVAILABILITY OF PRODUCTS
Pharbes del Dott. Bellomo Domenico accepts the customer's orders within the limits of the quantities of the requested products in stock. Therefore, the acceptance by Pharbes of Dr. Bellomo Domenico of the purchase proposal submitted by the Customer is subject to the availability of the products in stock. Pharbes del Dott. Bellomo Domenico undertakes to promptly notify the Customer of any unforeseeable out of stock due to excess demand or other causes.
6. WARRANTIES AND ASSISTANCE
For the products purchased by the Customer, the rules on guarantees and assistance relating to the sale of consumer goods are applicable. To use the warranty, the Customer must keep the invoice / receipt. By accepting the purchase agreement, the Customer declares to have taken note of the assistance procedures in force at the time of the use of warranty assistance.
The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging.
7. OBLIGATIONS OF THE CUSTOMER
The Customer declares and guarantees: to be a consumer in accordance with the provisions of art. 3 of the Consumer Code; to be of age; that the data provided by the same for the execution of the Contract are correct and truthful.
8. RIGHT OF WITHDRAWAL
8.1 Methods
The right of withdrawal is regulated by the D.L. n ° 206 of 06/09/2005. The Customer (i.e. a natural person who purchases the goods for purposes not related to his professional activity) has the right to withdraw from the purchase contract for any reason. To exercise this right, the Customer must send a communication to Pharbes del Dott. Bellomo Domenico within 14 working days from the date of receipt of the goods by means of an explicit declaration (eg letter sent by post, fax or e-mail).
8.2 Return of the product
The customer who intends to make use of the right of withdrawal must return the products within 30 days of receipt of the products. The products must have a copy of the sales document (tax receipt in the case of a private individual - DDT in the case of a company) as well as the order number, such as, surname, and address of the Customer.
Pursuant to Article 55, second paragraph, of the Consumer Code, the Customer will not have the right of withdrawal in the following cases:
- supply of audiovisual products or sealed software, opened by the Customer;
- supply of products made to measure or personalized, or which by their very nature, cannot be returned or are liable to deteriorate or expire rapidly (eg cosmetics, flowers, foodstuffs);
- supply of newspapers, periodicals and magazines.
8.3 Product return costs
The costs are charged to the customer. Pharbes of Dr. Bellomo Domenico will return, within 30 days from the date of receipt of the products by the Customer, the full price paid by the Customer in case of return of the product complete with all its parts and functions.
8.4 Forfeiture of the right of withdrawal
The right of withdrawal is totally lost, for lack of the essential condition of integrity of the property (packaging and / or its contents), in cases where Pharbes del Dott. Bellomo Domenico ascertains:
• use, even partial, of the goods and of any consumables;
• lack of the external packaging and / or the original internal packaging;
• damage to the product for reasons other than its transport;
• absence of integral elements of the product (accessories, parts, etc.).
In the cases indicated above, Pharbes del Dott. Bellomo Domenico will return the purchased good to the sender, charging the shipping costs to the sender.
8.5 Return of incorrect product
If an incorrect product is delivered, Pharbes by Dr. Bellomo Domenico will collect the item at his own expense. Just contact Customer Service and report the error.
8.6 - Causes of force majeure
Pharbes of Dr. Bellomo Domenico will not be responsible for failure or delay in delivery due to force majeure, such as (by way of example) strikes, provisions of the Public Authority, rationing or shortage of energy or raw materials, transport difficulties, fires, floods. , flooding and damage to industrial machinery not dependent on Pharbes, which, in any case, will promptly notify the Customer of the occurrence and the absence of a force majeure event. If the cause of force majeure persists for a period exceeding 30 (thirty) days, each party will have the right to withdraw from the contract. In the event of withdrawal, the Customer will not be entitled to any indemnity or compensation for any reason, without prejudice to the right to the refund of any amount already paid as a price for the Product object of the Order.
9. TREATMENT AND CONFIDENTIALITY OF PERSONAL DATA INFORMATION PURSUANT TO D.LGS. 196/03
9.1 Privacy
Pursuant to and for the purposes of the provisions of Legislative Decree of 30 June 2003, 196 Code regarding the protection of personal data (hereinafter the "Code"), we inform you that your personal data, provided and / or acquired subsequently, they will be processed by Pharbes, in Italy and abroad, through electronic and manual tools in compliance with the Code and current legislation on privacy.
9.2 Purpose of the processing
The collected data are processed for the following purposes:
to. subscribe to the service;
b. conclude purchase and sale contracts and carry out the service;
c. carry out the formalities necessary to execute the contractual relationship in place;
d. send commercial information, advertising, informative and promotional material, by any means (e-mail, text message, etc.).
9.3 Data Retention
All the acquired data cannot be used for other purposes than those indicated above and will be kept for the period necessary for the realization of the same. After this deadline, the data will be deleted or transformed into anonymous form. For detailed data on purchases and services, storage times will not exceed those established by current legislation.
9.4 Rights of the interested party
Your right to exercise the rights referred to in Article 7 (Right of access to personal data and other rights) of the Code at any time remains unaffected, in particular: the right to access your personal data, request its correction, 'updating and cancellation if incomplete, erroneous or collected in violation of current legislation, as well as to oppose their treatment for legitimate reasons, by sending a written request to Pharbes of Dr. Bellomo Domenico Agrigento Dr. Domenico Bellomo - Via P. Mattarella, 6 - 92100 Agrigento and / or by mail to info@elailab.com.com.
9.5 Data Controller

10. JURISDICTION
The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and violation of the Contract will be the responsibility of the Court of Agrigento.
